§1 Scope & Provider

These Terms and Conditions ("Terms") govern the contractual relationship between Centric Software International Ltd. ("Provider", "we") and the users ("user", "you") of FelisCare, available at feliscare.app and as an iOS app.

By using the service you accept these Terms. Where the app is obtained through a distribution platform (e.g. the Apple App Store), that platform's terms apply in addition; for the purchase of the app itself you are the platform's direct contracting party.

Any deviating, conflicting or supplementary terms of the user do not become part of the contract unless the Provider expressly agrees to them in writing.

§2 Description of Service

FelisCare is a digital reference work on illnesses, complaints and emergencies of the cat. The service provides editorial content: conditions arranged by body region, each divided into sections such as symptoms, first measures, causes, treatment by the vet and prognosis, plus emergencies, checklists, a nutrition guide and a freely readable tip of the month.

Users can search and sort the content and bookmark individual entries. Logged-in users on a plan that includes synchronisation keep bookmarks, purchased unlocks and profile details in step across their devices; without an account, everything stays on the device.

Which content is freely readable and which requires a purchase is set out in §5. The lists themselves are always open: only opening an individual paid entry is restricted.

The Provider develops the service continuously and extends or revises the content. There is no entitlement to the permanent availability of individual features, entries or design elements; §10 remains unaffected.

§3 Not Veterinary Advice

FelisCare does not replace a veterinarian. The content serves the general information of the owner. It is not veterinary advice, not a diagnosis and not a treatment instruction, and using it does not create a treatment relationship.

Breed, age, pre-existing conditions, medication and the course of an illness cannot be judged from a text. If an emergency is suspected, if the condition worsens, or in case of doubt, veterinary help must be sought immediately. Nothing in FelisCare justifies delaying veterinary help.

Statements on dosage, feeding, home remedies and first measures are points of reference, not instructions. The Provider prepares the content to the best of its knowledge but does not owe accuracy, completeness or currency in the individual case; veterinary medicine advances. For damage arising from applying or not applying the measures described, the Provider is liable in accordance with §11.

§4 Account & Formation of Contract

An account is required only for search, bookmarks and syncing across multiple devices; without an account, all content can be read entirely locally on one device, and a purchase is possible without an account too: it then remains limited to the device used. An account is created by providing an email address and password (at least 8 characters). After registration the user receives a confirmation email; the contract is formed once the link contained in it has been confirmed.

The account applies exclusively to FelisCare. Sister applications of the Provider (such as CanisCare for dogs or EquusCare for horses) maintain separate accounts with their own credentials and their own purchases, even where the same email address is used. A plan purchased in FelisCare does not apply there.

The user undertakes to provide truthful information when registering and to keep their credentials confidential. Use is permitted equally to consumers and businesses. Registration requires the user to be at least 16 years old or to have the consent of a parent or guardian.

§5 Plans, Prices & Payment

FelisCare is offered in plans, alongside individual unlocks. All prices include statutory VAT at the applicable rate.

  • Free: permanently free of charge. All lists, search, bookmarks and the tip of the month are freely accessible; individual entries are chargeable. With advertising, without synchronisation between devices.
  • Premium: €3.99 as a one-time purchase, no automatic renewal. Removes the advertising, unlocks synchronisation of profile and content between the user's devices, and gives full access to the nutrition guide, emergencies and checklists.
  • Premium Plus: €4.99 per month, cancellable monthly, renewing automatically until cancelled. Includes everything in Premium plus access to the chargeable content without individual purchase.
  • Individual unlocks: €1.99 for a single entry (one illness, one emergency, one checklist) and €4.99 for a whole group (one body region, all emergencies, all checklists). Both are one-time purchases without a term; they do not renew.

Purchases are processed through the distribution platform (Apple App Store); the platform is the contracting party for the payment. No setup fee applies. A purchase does not require an account (§4); without an account it remains limited to the device used. With an account, it is additionally assigned to that account and therefore also available on further devices of the user.

A running subscription renews automatically for the respective period unless cancelled at least 24 hours before the end of the period via the account settings of the distribution platform.

§6 Term, Cancellation & Withdrawal

The free account (Free) runs for an indefinite period and can be terminated by the user at any time via the danger zone in the profile (§12). Premium and the individual unlocks are one-time purchases without a term and therefore cannot be cancelled; they remain permanently tied to the purchasing App Store account.

Premium Plus is a subscription with a term of one month. It renews automatically unless cancelled at least 24 hours before the end of the period via the account settings of the distribution platform; cancellation takes effect at the end of the current period.

Right of withdrawal for digital content

Consumers have a statutory right of withdrawal. This right expires early where the user has expressly agreed to immediate performance of the contract before the withdrawal period elapses and has confirmed that they thereby lose their right of withdrawal, for example through the immediate unlocking of an entry or a plan after purchase. Exercising the right of withdrawal follows the distribution platform's terms.

§7 User Obligations

The user undertakes to

  • use the service only within the bounds of applicable law,
  • not treat the content as a substitute for veterinary help (§3) and not pass it on commercially as advice to third parties,
  • keep their credentials confidential and not grant third parties access to their account,
  • not reproduce, make publicly available or pass on purchased content (§9),
  • refrain from any measures that could impair the operation of the service or its server infrastructure (such as automated mass requests to the content endpoints or reverse engineering beyond what is legally permitted).

In case of breaches of these obligations, the Provider may restrict access or suspend the account after prior warning.

§8 Data, Content & Storage

The user remains the owner of the details they create: bookmarks, notes and the details about their cat. The editorial content of the service itself remains with the Provider (§9).

Where the user is logged in and holds a plan that includes synchronisation (§5), bookmarks, unlocks and profile details are stored, in addition to the device, as a backup on the Provider's server so they are available on another device or after a reinstall. The file resides in a dedicated directory assigned to the account and is not directly accessible over the web; only the server reads it, and authorisation is checked on every access.

Without an account and on the Free plan, these details remain solely on the device; they are lost if the app is deleted. See the Privacy Policy for details.

The account applies to FelisCare only. The Provider's sister applications ( such as FelisCare for cats or EquusCare for horses) run separate accounts with their own credentials and their own purchases, even with the same email address. A plan purchased in FelisCare does not apply there.

§9 Usage Rights & Intellectual Property

All rights to the service and its content (software, design, logos, the FelisCare brand and the editorial texts on illnesses, emergencies, checklists and nutrition) belong to the Provider or its licensors.

The user is granted a simple, non-transferable, non-sublicensable right to use the service and the content unlocked for them within the scope of these Terms for their own, non-commercial purposes. An unlock initially resides on the device on which it was acquired; where it is assigned to an account, it additionally applies to that account. It is not transferable.

Reproduction, distribution, making publicly available and editing of the content outside the cases permitted by law are prohibited, as are reverse engineering, removal of rights notices and distribution of modified versions, except where legally permitted.

The Provider acquires no rights in the details created by the user beyond what is technically necessary for operating, displaying, backing up and delivering the service.

§10 Availability & Changes

The Provider endeavours to ensure high availability of the service but cannot guarantee uninterrupted availability. Maintenance work, technical faults or events outside the Provider's control (force majeure, failures of third parties such as hosting providers) may lead to temporary restrictions. No availability commitment in the form of a service level agreement exists.

The Provider reserves the right to adapt, extend or discontinue individual features as part of ongoing development, provided this is reasonable taking into account the user's legitimate interests.

§11 Liability

The Provider is liable without limitation for intent and gross negligence, under product liability law, for injury to life, body or health, and within the scope of any guarantees assumed.

For slightly negligent breach of a material contractual obligation (cardinal obligation), the fulfilment of which is essential for the proper performance of the contract and on whose observance the user may regularly rely, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slightly negligent breaches of duty is excluded.

For loss of data, the Provider is only liable to the extent that would have arisen despite proper and regular data backup by the user.

The Provider assumes no responsibility for decisions a user makes about the health of their animal on the basis of the content; the content is not veterinary advice (§3, see also the Disclaimer).

§12 Suspension & Account Deletion

The user may irrevocably delete their account in the app at any time. This removes all bookmarks, notes and profile data from the server and deactivates the account. Purchased unlocks lapse with it; there is no claim to a refund. This action cannot be undone.

Deletion affects only the FelisCare account. The user's accounts with other applications of the Provider (including the sister applications for other species) remain unaffected and must be deleted separately there.

The Provider is entitled to suspend or terminate an account in the event of a serious or repeated breach of these Terms after prior warning with a reasonable deadline.

§13 Changes to these Terms

The Provider reserves the right to amend these Terms with effect for the future, insofar as this is necessary for legal reasons, due to changes in the service's functionality, or to adapt to changed technical or economic circumstances, and does not unreasonably disadvantage the user. Users will be informed of material changes in the app or by email with reasonable notice.

If the user does not object to the amended Terms within six weeks of receiving notice of the change, or continues to use the service after this period expires, the amended Terms are deemed accepted.

§14 Final Provisions

English law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where the user is a consumer, this applies only insofar as it does not restrict the protection afforded by mandatory consumer protection provisions of the user's habitual place of residence.

Where the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction (to the extent legally permissible) for all disputes arising from or in connection with this contract is the Provider's registered seat in London, England.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.

The European Commission provides a platform for online dispute resolution, available at ec.europa.eu/consumers/odr. The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
